Eyes on ergonomics

Last month we told you about New York State implementing a new Ergonomics Requirement mandating:

  • Annual onsite evaluations by a qualified Ergonomist.
  • Control of ergonomics exposures (including work pace)
  • Employee training
  • Onsite medical & first aid services (with specific requirements)

This law takes effect June 1st—in less than a month! It will apply to all employers with 100 direct (or indirect) employees at a single warehouse distribution center site OR that have a total of at least 1,000 employees at one or more warehouse distribution centers in the State of New York.

  1. Particulates are defined as:
    a. A gaseous form of a substance that is normally a solid or liquid at room temperature
    b. Solid Particles generated by mechanical action (crushing, grinding) with a sizerange from 0.1 to 30 micron (μm)
    c. Fine solid or liquid particles, such as dust, fog, mist, smoke, or spray
    d. size range from 0.001 to 1 micron (μm)
  2. Atmospheric testing in Confined Spaces is required for two distinct purposes: evaluation of the hazards of the permit space and verification that acceptable conditions exist forentry into that space. Confined spaces should be tested in the following order, from first to last:
    a. Oxygen, toxic gases and vapors, combustible gases
    b. Oxygen, combustible gases, toxic gases and vapors
    b. Toxic gases and vapors, oxygen, combustible gases
    c. Toxic gases and vapors, combustible gases, oxygen

  1. c. Fine solid or liquid particles, such as dust, fog, mist, smoke, or spray

    Explanation: Explanation:
    a. Is the definition of Vapors
    b. Is the definition of dust
    c. Is the definition of Particulates

    Also, note the following relevant definitions:
    Mist: Suspended liquid droplets generated by condensation or atomization with a size range of 0.01 to 10 microns
    Fibers: Particulate with an aspect ratio (length to width) of 3:1

2. b. Oxygen, combustible gases, toxic gases and vapors

Explanation: Before a permit confined space (that may have a hazardous atmosphere) can be entered, the atmosphere must be tested using the steps identified on the confined space permit. Verification testing is done to make sure that the chemical hazards that may be present are below the levels necessary for safe entry, and that they meet the conditions identified on the permit. The atmosphere for confined spaces should be tested in the following order: (1) for oxygen, (2) for combustible gases, and then (3) for toxic gases and vapors. Then, the testing results (the actual test concentrations), must be recorded on the permit near the levels identified for safe entry. Test the permit space routinely to make sure that the atmospheric conditions continue to be safe for entry.
